Provocative dress order: HC stays judge’s transfer


KOCHI: The Kerala HC on Friday stayed the transfer of the district judge who had passed the “sexually provocative dress” judgment last month. Hearing S Krishnakumar’s plea against his transfer to a labour court, an HC division bench comprising Justice A K Jayasankaran Nambiar and Justice Mohammed Nias CP stayed the shift while it hears the judge’s appeal.
Granting anticipatory bail to Civic Chandran on August 12 over allegations of sexual harassment, Krishnakumar had observed that such a case would not prima facie stand if the victim was wearing a ‘sexually provocative dress’. In his appeal, Krishnakumar contended that only district judges with a smaller service span are appointed judges of labour courts. As he is retiring in May, he should be allowed to continue in Kozhikode.
